Terms of service
Effective date: 12 August 2026
Overview
This website, https://www.joyclik.com, is owned and operated by JoyClik™, a digital wellness business based in New Zealand.
In these Terms of Service, “JoyClik”, “we”, “us” and “our” refer to JoyClik™. “You” and “your” refer to anyone who visits our website, creates an account, purchases or downloads a product, or otherwise uses our services.
“Products” means the digital journals, guides, workbooks, cards, printable tools, templates, educational resources and other downloadable content offered by JoyClik.
These Terms govern your use of our website and Products. They should be read together with any product-specific information and the policies linked on our website.
By using our website or completing a purchase after being given access to these Terms, you agree to be bound by them. If you do not agree, please do not use our website or purchase a Product.
Our online store is hosted by Shopify, which provides the e-commerce platform through which we offer our Products.
1. Adult Purchases and Website Use
You must be at least the age of majority in your country, state or province to make a purchase, create an account or provide personal information through our website.
Some JoyClik Products are designed for a parent, caregiver or other responsible adult to use with a child. Children should not make purchases, create accounts or provide personal information directly through our website.
If you allow a child to use an age-appropriate Product, you are responsible for providing suitable adult guidance and supervision.
You may only use our website and Products for lawful, personal and authorised purposes.
2. Product Information
Unless a product page clearly states otherwise, JoyClik Products are digital products. No physical item will be shipped.
We take reasonable care to describe each Product accurately, including its purpose, format, contents, compatibility and intended use. Please review the complete product description before purchasing.
Product images, mockups and previews are provided to help you understand the Product. Colours and visual details may vary slightly depending on your screen, device, printer, paper, software and display settings.
Where a product page includes specific conditions, licence terms or usage instructions, those product-specific terms form part of your agreement with us. If they conflict with these Terms, the more specific product terms will apply to that Product.
3. Orders, Prices and Payment
Prices are displayed in the currency selected through the website or shown at checkout. The final amount payable, including any applicable taxes handled through the checkout, will be displayed before you complete your purchase.
Prices and product availability may change for future purchases without notice. A price change will not affect an order that has already been accepted and paid for.
You agree to provide accurate and current billing, contact and order information.
Payments are processed by Shopify and/or authorised third-party payment providers. Their own terms and privacy practices may also apply to the payment services they provide.
We may decline, review or cancel an order where we reasonably believe that it:
- is fraudulent or unauthorised
- contains an obvious pricing or technical error
- has been placed for resale, redistribution or another prohibited purpose
- breaches these Terms or applicable law
If we cancel a paid order before the Product is supplied, we will refund the amount paid using the original payment method, unless another lawful arrangement is agreed with you.
4. Digital Delivery and Immediate Access
Digital Products are usually made available after payment has been successfully processed. Access may be provided through the checkout thank-you page, email, a customer account or another delivery method described on the product page or at checkout.
You are responsible for:
- providing the correct email address
- checking your inbox, spam, junk and promotions folders
- using a compatible device, browser, application and internet connection
- maintaining sufficient device storage
- downloading and securely saving your Product
Unless we expressly promise ongoing access, customer-account or download-link availability should not be treated as permanent file storage. We recommend downloading and backing up your purchase promptly.
If you experience a genuine delivery, download or access problem, contact us at care@joyclik.com, and we will take reasonable steps to help.
Where an immediate-access acknowledgement is presented at checkout, selecting it means you expressly request that digital supply begin before any applicable cancellation period has ended. Where permitted by law, you acknowledge that your change-of-mind cancellation right may end once digital supply begins.
This does not affect your rights if a Product is faulty, inaccessible, incomplete, corrupt, materially different from its description or otherwise fails to meet a mandatory consumer guarantee.
Further information is available in our Digital Delivery Policy.
5. Personal and Household Licence
When you purchase a JoyClik Product, you receive a limited, non-exclusive and non-transferable licence to use it for personal, non-commercial purposes. You do not acquire ownership of the Product or its underlying intellectual property.
Your licence allows you to:
- download and save the Product on your personal devices
- use fillable or interactive features where included
- print a reasonable number of copies for your own personal use
- use an appropriate family Product with members of your immediate household or children in your care
- keep a private backup copy for your own use
For Products designed for parents, caregivers and children, the purchasing adult may use the Product with the children in their own care. This does not permit sharing the digital file with another household, organisation or professional practice.
Unless JoyClik gives written permission or offers a separate licence, you must not:
- sell, resell, sublicense or rent the Product
- share the digital file with another person or household
- upload it to a public or shared drive, website, group, membership platform or file-sharing service
- distribute it through email, social media, messaging platforms or online communities
- reproduce it for other families, clients, students, classrooms or groups
- use it in counselling, therapy, coaching, consulting, teaching, workshops, courses or paid programmes
- modify, rebrand or adapt it for resale, distribution or commercial use
- remove copyright, trade mark, branding or ownership notices
- present the Product, its wording, design or original materials as your own
A licence may be suspended or revoked where there has been a material breach of these Terms, fraud or unauthorised distribution. This does not remove any consumer right that cannot legally be excluded.
For professional, educational, group or commercial licensing enquiries, contact care@joyclik.com.
6. Intellectual Property and Trade Marks
The JoyClik website and Products contain original content owned by or licensed to JoyClik.
This includes original text, journals, guides, workbooks, worksheets, cards, templates, graphics, illustrations, layouts, page designs, downloadable files, branding, logos, product names and the original selection, arrangement and expression of educational materials.
These materials are protected by applicable copyright, trade mark and other intellectual property laws.
The personal and household permissions in section 5 are limited exceptions to these ownership rights. No other right to copy, publish, adapt, distribute, licence or commercially exploit JoyClik content is granted.
JoyClik™, The Joyflow Wheel™, Emotion Coaching at Home™ and The Sleep Reset Journal™ are trade marks used by JoyClik. Other product or company names belong to their respective owners.
Unauthorised copying, resale or distribution may result in access restrictions, platform takedown requests or other remedies available under applicable law.
7. Educational and Wellness Scope
JoyClik Products and website content are provided for educational, informational, reflective and personal self-support purposes.
They are not:
- medical or psychological advice
- mental health treatment
- therapy or counselling
- diagnosis or clinical assessment
- crisis or emergency support
- legal or financial advice
- a substitute for individual support from a suitably qualified professional
You are responsible for deciding whether a Product is appropriate for your circumstances and for how you use the information and reflective activities it contains.
JoyClik does not guarantee a particular emotional, health, sleep, parenting, relationship, lifestyle or personal-development outcome. Individual experiences vary according to personal circumstances, needs and engagement.
If you are experiencing a medical emergency, mental health crisis, suicidal thoughts or immediate danger, contact your local emergency services or an appropriate crisis-support service.
Please read our Professional & Medical Disclaimer, which forms part of these Terms.
8. Refunds and Consumer Rights
Because digital Products cannot usually be returned after they have been supplied, accessed, opened or downloaded, JoyClik does not generally offer refunds for change of mind after digital delivery has begun.
This change-of-mind position does not limit your rights under applicable consumer law.
If a Product is faulty, inaccessible, incomplete, corrupt, materially different from its description or does not meet an applicable consumer guarantee, contact us at care@joyclik.com. Depending on the circumstances and applicable law, an appropriate remedy may include assistance, replacement, correction or refund.
Duplicate purchases, payment errors and genuine access problems will be considered fairly according to the circumstances and applicable law.
JoyClik is based in New Zealand and recognises that customers may have mandatory rights under the laws that apply where they live. These may include:
- the Consumer Guarantees Act 1993 and Fair Trading Act 1986 in New Zealand
- the Australian Consumer Law
- the Consumer Rights Act 2015 and Consumer Contracts Regulations in the United Kingdom
- applicable federal, provincial and territorial consumer laws in Canada
- applicable federal and state consumer laws in the United States
Nothing in these Terms excludes, restricts or modifies a right or remedy that cannot legally be excluded.
Please read our Refund Policy for further information.
9. Customer Accounts and Security
If you create or use a customer account, you are responsible for keeping your login details secure and for activity carried out through your account.
You must not:
- share account access with unauthorised users
- attempt to access another person’s account
- use an account to distribute purchased Products
- interfere with account, checkout or website security
Please notify us promptly if you believe your account or download access has been used without authorisation.
We may take reasonable steps to protect accounts, Products and customer information, including requesting verification before restoring access or discussing an order.
10. Third-Party Tools, Services and Links
Our website may use or link to third-party services, including Shopify, payment processors, customer-account services, digital-delivery systems, analytics providers, email platforms and other website tools.
We do not control every third-party service and cannot guarantee that each service will always be available, uninterrupted or compatible with every device.
Your use of a third-party service may be subject to that provider’s own terms and privacy policy.
Links to external websites are provided for convenience, reference or further information. A link does not necessarily mean that JoyClik endorses or controls the external website, its content or its practices.
Nothing in this section excludes responsibility that JoyClik cannot legally exclude.
11. Reviews, Feedback and Submissions
If you submit a review through a review form or otherwise clearly provide content for public review or testimonial purposes, you give JoyClik permission to display and use that review in connection with the Product and JoyClik’s marketing.
We may correct spelling, grammar, formatting or length while preserving the reviewer’s meaning. We will not materially change the substance of a review.
Any name, location or other identifying information will only be used as provided or agreed for the review.
Customer-support messages, private wellbeing information and personal correspondence will not be treated as public testimonials without appropriate permission.
You must not submit content that is unlawful, fraudulent, misleading, abusive, defamatory or that infringes another person’s rights. We may decline or remove content where reasonably necessary for legal, safety, authenticity or moderation reasons.
General suggestions and non-confidential product feedback may be used to improve our Products and services, but this does not give JoyClik permission to publish your private personal information.
12. Privacy
Our collection and use of personal information is governed by our Privacy Policy.
Our website, checkout and customer accounts are intended for adults. We do not knowingly collect personal information directly from children.
Information about cookies and website preferences is available in our Cookie Notice.
13. Website Availability, Errors and Changes
We take reasonable care to keep our website, product descriptions and purchasing information accurate and available.
Occasionally, information may contain a typographical, pricing, technical or other error. We may correct an error and update website information when reasonably necessary.
If an error materially affects an order you have already placed, we will contact you and provide an appropriate option, which may include confirming the corrected information or cancelling and refunding the order.
We may update, improve or discontinue a Product or website feature for future customers. This will not remove a statutory right or change the essential terms of a completed purchase without a lawful basis.
Temporary interruptions may occur because of maintenance, technical problems, third-party outages, security concerns or events outside our reasonable control. We will take reasonable steps to restore affected services where practicable.
14. Prohibited Use
You must not use our website, Products or services:
- for an unlawful, fraudulent, harmful or misleading purpose
- to infringe JoyClik’s or another person’s intellectual property rights
- to distribute malware, viruses or destructive code
- to interfere with website, account, checkout or download security
- to scrape, harvest or collect information without authorisation
- to impersonate another person or misrepresent your identity
- to submit false billing, account or order information
- to harass, threaten, abuse or discriminate against another person
- to resell, redistribute or commercially exploit a Product
- to bypass product-access, licence or security restrictions
15. Suspension or Termination
We may reasonably restrict or suspend website, account or download access where we believe there has been:
- a material breach of these Terms
- unauthorised sharing, resale or distribution
- fraud or attempted fraud
- a security threat
- unlawful use
- misuse of an account or download system
Where appropriate and lawful, we will try to explain the reason and provide an opportunity to resolve the issue.
Suspension or termination does not remove obligations or liabilities that arose before access ended. It also does not remove any consumer right that cannot legally be excluded.
16. Warranties and Limitation of Liability
JoyClik does not guarantee that the website, customer-account services or third-party delivery systems will always be uninterrupted, error-free or compatible with every device or application.
You are responsible for following any compatibility, download, printing and usage information disclosed before purchase.
To the fullest extent permitted by law, JoyClik will not be responsible for:
- loss caused by using a Product for an unintended or prohibited purpose
- loss caused by unauthorised modification or redistribution
- customer-side device, storage, software or internet problems not caused by JoyClik
- indirect or consequential loss that was not reasonably foreseeable
- business or professional loss arising from a Product licensed only for personal use
- delay or interruption caused by events outside our reasonable control
Where liability cannot lawfully be excluded, it will be limited only to the extent and remedies permitted by applicable law.
Where legally permitted, JoyClik’s total liability for a claim relating to a Product will not exceed the amount paid for that Product. This limitation does not apply where it would restrict a mandatory consumer remedy or other liability that cannot legally be limited.
Nothing in these Terms excludes or limits liability for fraud, wilful misconduct, or death or personal injury caused by negligence where applicable law does not permit that exclusion.
17. Responsibility for Misuse
You are responsible for loss directly caused by your intentional unlawful use of the website, deliberate infringement of JoyClik’s intellectual property or unauthorised commercial distribution of a Product.
Where permitted by law, you may be responsible for reasonable and foreseeable costs arising directly from that misuse.
This section does not impose responsibility beyond what is fair, lawful and reasonably necessary to protect JoyClik’s legitimate interests.
18. Concerns, Complaints and Payment Disputes
If you have a concern about an order, payment, download or Product, please contact us first so we can try to resolve it promptly and fairly.
Please provide:
- your name
- your order number, where applicable
- the email address used at checkout
- a clear description of the issue
Contacting us first does not prevent you from exercising a statutory consumer right, contacting a consumer authority or using a lawful payment-dispute process.
If a chargeback or payment dispute is initiated, we may provide the payment provider with relevant order, delivery, access, policy and communication records, subject to applicable privacy law.
We may restrict access where a payment has been reversed because of proven fraud or unauthorised use. We will not use this section to prevent a genuine consumer claim.
19. Governing Law and International Customers
These Terms and your use of the JoyClik website are governed by the laws of New Zealand, to the extent that this choice is permitted.
Any dispute that cannot be resolved informally may be considered by the courts of New Zealand, subject to any mandatory right you have to bring a claim in another country, state, province, territory or forum.
If you purchase from outside New Zealand, nothing in these Terms removes a mandatory consumer protection that applies to you and cannot lawfully be waived.
20. Changes to These Terms
We may update these Terms to reflect changes to our Products, website, business practices or legal obligations.
The effective date at the top of the page will be updated when changes are made. Where required, we will provide reasonable notice of a material change.
Updated Terms apply to future website use from their effective date. The terms in effect when you completed a purchase will generally continue to govern that purchase unless a change is required by law or agreed with you.
21. General Terms
These Terms, together with the policies and product-specific terms referenced on our website, form the agreement between you and JoyClik concerning your use of the website and Products.
If part of these Terms is found to be unlawful or unenforceable, that part will apply only to the maximum extent legally permitted. The remaining provisions will continue to apply.
If JoyClik does not immediately enforce a right under these Terms, that does not mean the right has been waived.
Section headings are provided for clarity and do not change the meaning of the Terms.
